General
1. These Conditions of Sale are for all customers.
2. Goods are subject to availability.
3. You must decide before ordering if the goods are suitable for your needs.
4. Please note that we reserve the right to cancel or refuse orders for items shown on our website with an incorrect price, error, omission or with any other incorrect information. No contract is made with you until we have dispatched your order.
5. All items advertised for sale on this website are new and first class unless otherwise stated and are covered by the relevant manufacturer’s warranty. In the unlikely event of a claim against faulty goods or workmanship, such claims will be handled by us on your behalf.
Prices and Payment
6. Our advertised prices include VAT at the current UK standard rate, which will be charged to all UK 'Private Individuals' only.
6a. For non-UK customers, vat is automatically removed from products and delivery.
EU Pricing
6b. Pricing on our website is shown both inclusive of VAT (at the UK rate of 20%), and excluding VAT for customers outside of the UK.
Customers located within the European Union
The UK left the EU Customs Union on the 1st of January 2021. Prior to this date you would have paid 20% Sales tax (UK tax rate) and no import duty when purchasing from Motorcycle Performance Store.
From the 1st of January 2021, VAT (Sales tax) and import duty is now payable on any item(s) which you import from the UK.
All Motorcycle Performance Store products are sold with a Delivery Duty Unpaid (DDU) status and an import tariff may apply to your order. Customers will be contacted by the Customs and Excise authority in the destination country regarding payment prior to delivery, and it is important that the correct contact telephone number and email information be submitted with your order to facilitate this part of the delivery process.
Typical payment methods include credit card or cheque; please contact your local Customs and Excise authority for accurate payment method information. Your order will be released to the courier company for delivery by the Customs and Excise authorities as soon as the import duty has been paid. Please note tariff charge criteria vary, and it is the responsibility of customers to investigate the possible charge with their local Customs and Excise authority. Please note, carriage costs and related administration for the return of your order to Motorcycle Performance Store will not be refunded in the event of an import duty dispute and consequent order rejection.
7. We accept payments via most major Credit and Debit cards, direct bank transfer in GBP. Customers can also pay by PayPal or postal order.
Price Match Guarantee
7a. As part of our Price Match Promise, we guarantee that we'll beat or match the price of any product you find for less elsewhere. In order to take advantage of this promise, the product must adhere to the following criteria;
- It must be the same brand.
- It must be brand new.
- Its total price must include shipping costs/handling fees.
- Product must be from a registered business not an individual - Proof of product is mandatory.
- Price match only applicable prior to purchase, not once a sale is completed.
- We reserve the right not to price match if it's beyond our economical or financial boundaries.
- Price match guarantee does not include Ebay or Amazon items.
Delivery
8. Dispatch times are typically within 24 hours within the UK where we hold stock, although this may be longer dependent upon the availability of goods via our network of suppliers and this may take over 28 days. Delivery charges will be calculated automatically at the checkout depending on weight, value and the shipping address provided.
8a. Orders processed before 2pm will be sent next working day where stock applicable.
8b. Please be advised that once your order has been dispatched, we accept no responsibility for delivery timescales. Any issues or concerns regarding the delivery process, including delays, should be directed to the respective courier service handling your shipment. While we make every effort to ensure timely dispatch, the actual delivery timeframe is subject to the courier's policies and performance.
9. Our delivery charges include in-transit insurance but it is the customers responsibility to arrange safe receipt of goods. You may be liable for additional carriage charges where repeated attempted deliveries have failed.
10. On European or Worldwide sales, we reserve the right to hold back either stock until both items are able to be despatched.
11. Delivery charges are non-refundable when delivery has failed due to you having provided an incomplete or incorrect delivery address or contact details.
12. For all Non-UK Countries Import Duty may be charged by your Local Government agency, depending on the value of the goods. This is your sole responsibility and we cannot offer any advice on this, sorry. We are unable to accept returns for goods correctly supplied and rejected because of Import Duty charges.
Fitment of items
13. Warranty is void in the following situations:
- Damages, road/driving accidents, natural events.
- Inappropriate use of the motorbike (off road use, racing tracks, strong use).
- Any modification or manumission (also removing of the baffle and catalyst, painting).
- Inappropriate fitting of the exhaust on a vehicle which the exhaust is not designed for.
14. The mounting instructions process for all of our products is recommended to be done by a mechanic or competent individual.
15. Please follow the mounting instructions supplied.
16. We take no responsibility for any damage occurred during or after fitment.
17. We highly recommend a visual and audible check whilst the bike is in the workshop/workspace and up on stands before riding.
18. If no stands are available, then push the bike physically and perform the same checks visually and audibly
Cancellations, Returns and Refunds
19. Please contact us if you are thinking about cancelling your order. All delivery times are quoted in good faith and are approximate, subject to our suppliers and carriers fulfilling their contracts. During busy periods and in particular during the European Manufacturers summer holiday periods, you may experience a delay in receiving your goods. You will be advised of this at the time of ordering and may cancel your order immediately by e-mail if you do not wish to wait.
20. It is the customer's responsibility to ensure they are happy with all relevant details before placing an order. All the products on our website are designed to be fitted to standard OE motorcycles. If you have aftermarket parts fitted and unsure about compatibility, please consult with us before purchasing as we reserve the right to charge a handling / administration charge.
21. It is unacceptable for you to make a return or cancellation without our prior agreement. Conditions apply where we do decide to accept a cancellation or return. The product must be unopened and in perfect condition. Where we accept a return or cancellation, a handling / administration charge of 20% will apply.
21a. Returns must be received within 14 days of agreement to accept a return and P&P costs are non-refundable. Refunds will be processed within 2 working days upon receipt, inspection and approval of the return. If the return does not meet the required standards, then we will notify you regarding this. You will have the option of paying a delivery cost to have the item returned to you.
21b. Please note that courier delays, which are beyond our control, do not constitute a valid reason for returns. We recommend addressing any delivery-related concerns directly with the courier service.
22. Special Order goods which are not stock items and have been ordered in specially are 100% non-returnable and will be delivered within the time-scale agreed at time of order placement.
22a. In the event of a cancelled order, orders paid through Paypal will be refunded within 24 hours. Debit cards and Credit cards will be refunded back to your bank within 3-5 working days less any transaction fees.
Promotions
23. Various promotions may be offered by us and may be withdrawn at any time without prior notice.
24. Only one discount on DNA Air Filters can be claimed for every exhaust transaction.
Gift Vouchers
25. The use of gift vouchers falls under the following terms and conditions:
26. In order to purchase a Gift Certificate, you will need to register an account with us through our website.
27. Gift Certificates ordered through our website will be delivered automatically by electronic means to the email address you specify at the time of order. Our Gift Certificates include unique numbers and configurable patterns.
28. Our Gift Certificates must be redeemed on our website, as full or part payment of products from our website.
29. When ordering a Gift Certificate, you should ensure to enter the recipient’s email address correctly. We cannot be held responsible if the address is entered incorrectly and someone other than the intended recipient uses the Gift Certificate.
30. Site offers and promotions (including gifts with purchase and discounts) do not apply when purchasing gift vouchers.
31. You can check the balance of the Gift Certificate by logging into your account (please note, this only applies if you register for an account).
32. All Gift Certificates are dated and expire 12 months from the date of issue.
33. Gift Certificates cannot be exchanged for cash.
34. Gift Certificates may only be redeemed against products purchased in the same currency as the Gift Certificate.
35. Where Products purchased online with a Gift Certificate are returned, monies owing will be refunded by a Gift Certificate.
36. We are not responsible if a Gift Certificate is lost, stolen, destroyed or used without permission and no replacement will be provided in these circumstances.
37. A Gift Certificate cannot be used to purchase a further Gift Certificate.

Next Order Discount & Recommend a Friend
39. This offer is valid for 6 months from delivery.
40. When discount is redeemed by the original purchaser - 10% discount will only be applied on the most expensive item on the consecutive order. Next order discounts apply to QD, Termignoni, IXIL, IXRACE and Ironhead Exhausts, Puig Motoplastics and DNA Performance Air Filters only.
41. When discount is redeemed by a recommended friend - The recommender's name MUST be added to the order form online or over the phone.
